Process to Enter

To enter, all you have to do is tag the person you want to move in with on our Instagram post and tell us when you’re ready to move in together and make sure you’re following HER on Instagram. It’s that easy. You’re not required to use HER (but you should!). You are required to:

• Have an Instagram account
• Agree to be featured [on our Instagram and other web and social media] with your name and photo if you’re entry is selected
• Agree that your comments on the HER Instagram post may be featured [on our Instagram and other web and social media] 
• Ability to receive prize payout via Zelle, Venmo or Paypal
• Agree to all the terms and conditions herein

Entries open on October 24th, 2024, at 00:00 (12 AM) and end on November 30th 2024, at 23:59 (11:59 PM) Eastern Standard Time. Winners will be chosen at random and then contacted via Instagram to confirm they meet the requirements. We will announce the winners on our Instagram page within 7 days of the Sweepstakes closing.

Terms and Conditions Below:

1. No purchase is necessary to enter.
2. Entrants must be an individual aged 18 or over to enter.
3. Employees, contractors, and members of their immediate families (including any live-in partner or household member) of Bloomer Inc. (“HER”) or any Affiliate are not eligible to enter.
4. Entrants must have a residence in, and be moving entirely within,  the United States of America. 
5. Entrants must be able to receive funds via Venmo, CashApp or Paypal. 
6. The opening and closing dates and times for entries are as indicated in the Sweepstakes information above in the Process to Enter section. Any post comments received before the opening and after the closing of the Sweepstakes will not constitute sweepstakes entries.
7. Entrants post information must include only personal information about individuals for whom the entrant has informed consent to name or otherwise portray in the post.
8. By entering the Sweepstakes, entrants warrant that all information submitted by them is true, current, and complete. Entrants also represent and warrant that they are the copyright owners of any copyright works submitted, e.g. photographs and videos, that they have any required rights to participate in the Sweepstakes according to the guidelines, and HER’s use of such works (which you agree to as a condition of entry) will not infringe the rights of any third party.
9. Any limit on the number of entries a person  may make will be clearly stated in the Sweepstakes information. Entries received that exceed this limit will be invalid and will not be entered into the Sweepstakes.
10. By entering the Sweepstakes, you acknowledge and agree that neither HER nor its agents, nor any other party or organization involved in the management, promotion, or administration of the Sweepstakes or its entry routes or donation of prizes, or their agents or affiliates, have any responsibility or liability for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft, destruction, alteration of, or unauthorized access to entries, or for entries lost or delayed for any reason, virus, bugs, or other causes outside its control.
11. Any entries which are incomplete, illegible, incomprehensible, or not received by HER will be void. HER reserves the right in its sole discretion to determine when entries meet the Sweepstakes requirements.
12. In the event of any fault, mistake, misunderstanding or dispute concerning the correctness or acceptability of the entry or any answers given by entrants (if applicable), or the operation of any part of the Sweepstakes (in the case of postal entries, a postal strike for example), network or phone system, the decision of HER shall be final and no correspondence will be entered into.
13. HER will not be liable to reimburse expenses incurred in making an entry in any Sweepstakes.HER reserves the disqualify any entires where it suspects dishonest or fraudulent conduct on the sender’s part or where the entrant has not complied with the rules of the Sweepstakes.

Prizes

1. Up to (3) winners may receive up to $1500 reimbursement for their move of one or two persons to a single location. Reimbursements are conditioned on the submission of evidence of booked move. Reimbursements will be issued within sixty (60) days, conditioned upon the receipt of payment details (Zelle, Venmo or Paypal) and the address of the recipient, subject to The prize as specified in the Sweepstakes information.
2. The winner is required to send pictures and videos of their move for the purposes of a film or video for HER marketing. In order to accept and receive a prize, you will be required to provide a moving date and send at least 3 photo(s) and/or 3 videos of your move (the “Winner Required Content”) to HER at @hersocialapp on Instagram or hello@weareher.com. You further agree that HER may share, tag or otherwise reproduce any post you may make about the move or the Sweepstakes on any platform. By indicating acceptance of a prize, you grant Bloomer Inc. an irrevocable, worldwide, transferable, sublicensable license to use, copy, use, display, distribute, reproduce and make derivative works of any Winner Required Content. HER reserves the right to select an alternative winner in the event that these requirements are not met.
3. The winner(s) of the Sweepstakes will be chosen at random from among qualified entrants.
4. HER will attempt to notify the winner(s) within 7 days of the closing of the Sweepstakes entry period via the Instagram inbox of the account that posted the comment when entering the Sweepstakes. The winner will have a specified fixed time period to confirm their acceptance of the prize. If HER is unable to notify the winner, or if the winner fails to respond within the fixed time period as specified in the notice and/or provide accurate Venmo, Paypal, or Zelle info an address for delivery of the prize, then the prize if forfeit and HER will select an alternative winner in accordance with these terms and conditions.
5. HER may, in its sole discretion, refuse to provide a prize or seek its recovery in the event of an entrant’s breach of these terms or failure to meet one of the entry requirements, as determined in its sole discretion. HER’s website terms of use, fraud, dishonesty, or other inappropriate or improper conduct include but are not limited to the use of technology that enables an entrant to evade charges or entry requirements.
6. Any entrant who enters or attempts to enter the Sweepstakes in a manner which, in HER’s determination, is contrary to these terms and conditions or by its nature is unfair to other entrants may be removed from the Sweepstakes at HER’s sole discretion.
7. HER reserves the right to modify, cancel, terminate or suspend the Sweepstakes in whole or in part, at its sole discretion, if it believes the Sweepstakes is not capable of being conducted as specified in these terms and conditions or in the event of a virus, computer bug or unauthorised human intervention or any other cause that is beyond the reasonable control of HER that could corrupt or affect the administration, security, impartiality, or normal course of the Sweepstakes. HER is not obligated to select any winner or any particular number of winners.
8. HER reserves the right in its sole discretion to withhold delivery of the prize until the Entrant’s proof of eligibility and identity has been confirmed, or if such proof is not produced on request, and to disqualify the entrant from the Sweepstakes in its sole discretion.
9. No cash equivalent (where applicable) or alternative prize will be given, and the prize will be non-transferable and non-exchangeable. However, HER reserves the right to change the prize due to circumstances beyond its control or to offer an alternative of similar value.
10. In relation to all sweepstakes, the first name, likeness, Instagram handle, or entry comment of any winners may be published by HER, and entrants grant HER a non-exclusive license to use and publish their entry in any media for the purpose of announcing the winner.

Data Protection and Publicity

1. By submitting their personal details, the entrant agrees to HER processing those details in accordance with the purposes made known to the entrant at the time of collection and in accordance with HER’s privacy policy, which can be viewed at https://weareher.com/privacy/.
2. HER shall comply with all applicable requirements of the Data Protection Act 2018, the General Data Protection Regulation, any successor legislation or other applicable law.

Liability

1. Nothing in these terms and conditions shall exclude or limit HER’s liability for death or personal injury caused by their staff or supplier’s negligence or for fraud. Subject to this, HER cannot accept any responsibility for any damage, loss, injury or disappointment suffered by any entrant entering the Sweepstakes or as a result of accepting any prize. HER is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers, or providers, computer equipment, software failure of any email or entry to be received on account of technical problems or traffic congestion on the Internet, telephone lines or at any web site, or any combination thereof, including any injury or damage to entrant’s or any other person’s computer or mobile telephone related to or resulting from participation or downloading any materials in connection with the Sweepstakes.
2. HER cannot promise that the services relating to the Sweepstakes will be free from errors or omissions nor that they will be available uninterrupted and in a fully operating condition. These services may be suspended temporarily and without notice in the case of system failure, maintenance or repair or for reasons reasonably beyond the control of HER. HER will not be liable in the event that all or any part of the service relating to the Sweepstakes is discontinued, modified or changed in any way.

Standard Terms

1. In the event that any entrant does not, or is unable to, comply with and meet these terms and conditions and the Sweepstakes information, HER shall be entitled at its sole discretion to disqualify such entrant, without any further liability to such entrant. In these circumstances, any prize(s) won by the entrant may be forfeited and HER reserves the right to reclaim any prize(s) already distributed to the entrant. Any entrant must comply with any directions given to him or her by HER including but not limited to any and all relevant laws, rules and applicable regulatory codes.
2. The invalidity or unenforceability of any provision of these Terms and Conditions shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Terms and Conditions shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein.
